Which States Don’t Require a Home Care License? (And the Traps That Catch New Owners)

One of the most common questions we hear from people starting a home care business is, "How do I get my state home care license?" — only for the honest answer in some states to be, "You don't. There isn't one." That sounds like great news. In reality, it is where a lot of new owners get caught out. Here is the truth, and the traps to avoid.

Not every state licenses home care

Licensing in US healthcare is set state by state, and the rules vary enormously. Most states do license home care providers. But a handful do not license non-medical home care at the state level at all. Two of the clearest examples:

  • Michigan does not require a separate state home health agency license. Instead, the path runs through individual professional licensing and federal Medicare certification. (Assisted living-style services are handled separately by the state through the Homes for the Aged and Adult Foster Care framework.)
  • Ohio does not license non-medical home care at the state level either. The state's Certificate of Need rules apply only to nursing homes, and skilled home health runs through Medicare certification rather than a state home care license.

So if you are in one of these states and you go looking for a "home care license" application, you will not find one — and you may waste weeks searching for a document that does not exist.

Why "no license" does not mean "no compliance"

This is the trap. The absence of a state license does not mean you can simply open your doors. You still have a long list of obligations, and skipping them can be far more costly than any license fee:

  • HIPAA privacy and security rules still apply to your business, in full.
  • Policies and procedures are still expected — and will be scrutinised the moment you seek Medicare certification, contract with a payer, or face a complaint.
  • Medicare Conditions of Participation apply if you want to bill Medicare, and certification has its own demanding requirements.
  • Medicaid enrollment often has its own provider rules, separate from any license.
  • Background checks, training, and employment documentation are typically required regardless of licensing status.

In other words, the work does not disappear — it just shifts from "get a license" to "get your structure, documentation and certification right." Owners who assume "no license = nothing to do" are the ones who run into trouble at their first audit or payer contract.

How to avoid the trap

The single most valuable thing you can do early is get a clear, honest map of what your specific state and service type actually require — before you spend money in the wrong order. That means answering questions like:

  • Does my state license my type of service, or not?
  • If not, what is the real pathway — Medicare certification, Medicaid enrollment, professional licensing, or something else?
  • What documentation will I be held to even without a license?
  • What is the right sequence, so I am not paying for things out of order?

Get those answers wrong and you can lose months. Get them right and you can often launch faster, and cheaper, than you expected — especially in lower-barrier states.
